Agreement to Terms

These Terms and Conditions govern your use of Elite Motors website and vehicle rental services. By accessing our website or renting a vehicle, you agree to be bound by these terms.

Please read these terms carefully before using our services. If you disagree with any part of these terms, you may not access our services.

1. Definitions

For the purposes of these Terms and Conditions:

• "Company," "We," "Us," "Our" refers to Elite Motors, operating from Al Wasl Road 892, Dubai 10023, United Arab Emirates
• "Service" refers to premium vehicle rental services provided by Elite Motors
• "User," "You," "Your" refers to the individual accessing or using our Service
• "Website" refers to Elite Motors website and associated digital platforms
• "Vehicle" refers to any automobile rented through our services
• "Rental Agreement" refers to the contract executed at vehicle collection

2. Eligibility and Requirements

Age and License

To rent a vehicle from Elite Motors, you must:

• Be at least 21 years of age (25 years for certain vehicle categories)
• Hold a valid driving license for minimum 1 year
• Provide valid identification documents (passport or Emirates ID)
• Present International Driving Permit if applicable
• Have valid credit card for security deposit

Documentation

Required documents must be presented during vehicle collection and verified by our team before rental confirmation.

3. Vehicle Rental Terms

Reservations

• Reservations are confirmed upon receipt of deposit payment
• Vehicle availability is subject to confirmation at time of booking
• We reserve the right to substitute vehicles of comparable quality if necessary
• Rates are subject to change until reservation is confirmed

Payment Terms

• Deposit required at booking confirmation
• Balance payable upon vehicle collection
• Security deposit held on credit card during rental period
• Additional charges apply for mileage overages, fuel, damages, or violations
• All prices quoted in United Arab Emirates Dirham (AED)

Rental Period

• Rental period begins at vehicle collection and ends at return
• Extensions require advance notification and approval
• Late returns incur additional daily rates
• Early returns do not qualify for refunds unless agreed in advance

4. User Responsibilities and Obligations

Vehicle Care

You agree to:

• Maintain vehicle in same condition as received
• Operate vehicle in accordance with manufacturer specifications
• Use appropriate fuel grade as specified
• Monitor fluid levels and tire pressures regularly
• Report any mechanical issues immediately
• Return vehicle in clean condition

Legal Compliance

You must:

• Comply with all UAE traffic laws and regulations
• Pay all fines, penalties, or violations incurred during rental
• Not operate vehicle while impaired by alcohol or substances
• Not use vehicle for illegal activities
• Not transfer vehicle to unauthorized drivers

Prohibited Uses

Vehicles may not be:

• Driven outside UAE without written authorization
• Used for racing, competition, or performance testing
• Used for commercial transport services
• Driven on unpaved roads or off-road terrain
• Sublet or transferred to third parties
• Used to tow or push other vehicles

5. Insurance and Liability

Insurance Coverage

All rentals include:

• Comprehensive insurance coverage
• Third-party liability protection
• Collision damage waiver (subject to excess amount)
• Theft protection (subject to excess amount)

Your Liability

You are responsible for:

• Excess amount specified in rental agreement
• Damages resulting from prohibited uses or violations
• Loss or damage to personal belongings
• Interior damages including stains, burns, or tears
• Lost keys or documents

6. Cancellation and Refund Policy

Cancellation Terms

• Cancellations 48 hours prior to collection: Full refund of deposit
• Cancellations 24-48 hours prior: 50% deposit retained
• Cancellations less than 24 hours: 100% deposit retained
• No-show at collection: Full rental fee charged

Modifications

Booking modifications are subject to availability and may incur additional charges. Contact our team to discuss modification options.

7. Limitation of Liability

To the maximum extent permitted by law:

• Services provided on "as is" basis without warranties
• No guarantee of uninterrupted or error-free service
• Not liable for indirect, incidental, or consequential damages
• Total liability limited to fees paid for specific rental
• Not responsible for personal belongings left in vehicles
• Not liable for delays caused by circumstances beyond our control

8. Dispute Resolution

Governing Law

These Terms are governed by the laws of the United Arab Emirates. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of Dubai courts.

Resolution Process

In the event of disputes:

1. Initial attempt at informal resolution through direct communication
2. Mediation if informal resolution unsuccessful
3. Arbitration or legal proceedings as final resort

9. Modifications to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes become effective immediately upon posting to our website. Your continued use of services after changes constitutes acceptance of modified terms.

Material changes will be communicated through email notification or prominent website notices.

10. Severability and Waiver

Severability: If any provision of these Terms is found unenforceable or invalid, that provision shall be modified to reflect the parties' intention, and remaining provisions remain in full effect.

Waiver: Our failure to enforce any right or provision does not constitute waiver of such right or provision.

11. Entire Agreement

These Terms, together with our Privacy Policy and any rental agreements, constitute the entire agreement between you and Elite Motors regarding use of our services, superseding any prior agreements or understandings.
